(WTAQ-WLUK) — A judge Wednesday dismissed a lawsuit brought by two event venues, including one in Berlin, which challenged a law requiring them to obtain liquor licenses.
The bill, known as Act 73, requires special event venues, known generally as wedding barns, to either limit the number of times they serve alcohol in a year or obtain a liquor license. It was passed by the Legislature in November 2023.
Two such venues — Farmview Event Barn in Berlin and Monarch Valley Weddings and Events in Blair — sued to challenge the law.
But at a hearing Wednesday, Judge Rian Radtke ruled in the state Department of Revenue’s favor.
“Court finds conceivable rational basis for ACT 73, defendant entitled to judgment of dismissal,” court notes state.
The decision could be appealed to the Court of Appeals.
