MANITOWOC, WI (WTAQ-WLUK) – The suspect in the robbery of a Manitowoc gas station is not competent to stand trial, a judge rule Friday, halting the criminal case.
Justin Smith, 32, is charged with armed robbery for the May 9 incident at the BP gas station on Calumet Avenue.
Smith will be committed to a state psychiatric facility for treatment, court records show. If he is deemed competent to stand trial – meaning understands the court proceedings and can assist in his own defense – then the criminal case would resume.
According to a probable cause statement, Smith got away with $1,380 of cash.
Police say Smith did not display a weapon during the robbery but he is facing an armed robbery charge.
A $30,000 cash bond was set.
