APPLETON, WI (WTAQ-WLUK) — The Wisconsin Department of Justice’s Division of Criminal Investigation has completed its investigation into a fatal officer-involved shooting in Appleton, and turned it over to the Outagamie County district attorney for review.
An individual who allegedly shot at police at the Maritime Bar died when an officer returned fire on Jan. 23.
While it is typical for the state to identify the victim or the officer involved in such incidents while under review, that has not happened at this point. Despite multiple requests for those details, they have not provided.
A DOJ spokesperson confirmed Wednesday the case has been forwarded to District Attorney Melinda Tempelis for a determination if charges should be filed.
Tempelis’ office could not provide a timeframe Wednesday for how long the review would take.
Officials say when they arrived, they were confronted by an armed individual who shot at law enforcement. An Appleton police officer discharged their firearm, striking the individual. Life saving measures were performed and the person was taken to the hospital where they were pronounced deceased.
A firearm was recovered at the scene, 336 W. Wisconsin Ave.
Law enforcement was not injured in the incident.
The involved officer who discharged their weapon has been placed on administrative leave, per department policy. The involved officer was wearing a body camera during the incident.
