OSHKOSH, WI (WTAQ-WLUK) — Several civil lawsuits related to a boat crash on the Fox River will be merged, a judge ruled Friday.
Jason Lindemann was convicted criminally for the July 9, 2022 crash between his powerboat and the On The Loos paddlewheel cruise boat. He was sentenced to five months in jail and three years on probation, and ordered to perform 150 hours of community service and pay $11,702.79 in restitution.
Lindemann has filed a notice that he plans to appeal the conviction. There is a May 22 deadline for that filing, court records show.
Separately, Lindemann faces three civil lawsuits. The first was filed by On The Loos Cruises and its owners. The second was filed by Wendy Kohler. The third was filed by Troy Daun.
In court Friday, the attorneys in all three actions agreed to consolidating them into one case. Because of the pending criminal appeal, however, some of the discovery process may be impacted, court records show.
No trial date has been set. Another status conference is planned for April 11.
In June, a jury found Lindemann guilty of two felony counts of second-degree recklessly endangering safety, 11 misdemeanor counts of failing to provide aid after a boating accident and one misdemeanor count of negligent operation of a boat. He was acquitted of one count of failing to provide aid after a boating accident.
According to the criminal complaint, Lindemann was driving his powerboat on the Fox River when it collided with the On the Loos paddlewheel cruise boat just before 10 p.m. July 9, 2022. The paddleboat, carrying 44 people, suffered significant damage. Despite pleas from passengers on the damaged boat and nearby witnesses, Lindemann did not stop and render aid.
