FOND DU LAC, WI (WTAQ-WLUK) — Four years after a fatal overdose in Fond du Lac, a man was convicted for his role in the incident.
Officials announced Thursday that Michael J. Kimmons, 48, pleaded no contest to first-degree reckless homicide. His conviction stems from a deadly overdose in Fond du Lac on Jan. 5, 2021.
Kimmons is scheduled to be sentenced March 28.
According to the criminal complaint, the victim was found dead in his bed with a cell phone in his hands. The autopsy listed the man’s cause of death as cocaine and fentanyl toxicity, with obesity-related cardiomyopathy as being a contributing factor.
Cell phone data was reviewed, including messages exchanged between the victim and Kimmons on Jan. 2. Authorities discovered messages that were consistent with drug transactions.
When he was interviewed by police, Kimmons initially denied knowing the victim, then said he previously dated a relative of the victim and that was how the two had met.
Detective Hahn informed Kimmons that he reviewed messages that it appeared Victim 1 was looking for crack on January 4, 2021. Kimmons said it didn’t ring any bells and that he doesn’t sell any drugs. Detective Hahn explained that he believed Kimmons knew where Victim 1 could get drugs and that Kimmons assisted Victim 1 in getting drugs.
Detective Hahn pointed out messages in which Victim 1 told Kimmons he had $100-200 and gave Kimmons his address. Kimmons told Victim 1 he could get him “boy” or “hard” and he can smoke it by him. Detective Hahn stated the messages appeared to show Kimmons picked up Victim 1 and gave him a ride to get drugs.
The complaint says Kimmons said he had been clean for a while, but had used heroin and cocaine in the past. Kimmons told police “he isn’t a drug dealer” but he took the victim to purchase drugs the night before he was found dead. Kimmons stated that he and the victim went to Kimmon’s house to smoke together, and then the victim went home.
