MANITOWOC, WI (WTAQ-WLUK) โ The stateโs motion to dismiss the original child neglect charges filed against Katrina Baur and Jesse Vang has been granted, according to online records.
Manitowoc County Judge Robert DeWane granted the request Monday morning. The original motion for dismissal was filed on Friday.
In February, Jesse Vang was charged with chronic neglect of a child, party to a crime connected to the investigation into the disappearance of 3-year-old Elijah Vue. Katrina Baur, Vueโs mother, was also charged with chronic neglect of a child, party to a crime, as well as, resisting or obstructing an officer.
The charges were dismissed hours before the pair appeared in Manitowoc County Court Monday for the initial appearance connected to Vueโs death.
Last week, the Manitowoc County district attorney filed new charges against the pair.
Vang is now charged with physical abuse of a child โ repeated acts causing death, hiding a corpse and resisting or obstructing an officer.
Baur is now charged with chronic neglect of a child โ consequence is death, neglecting a child and resisting or obstructing an officer.
Bail was set at $500,000 for Vang on the new charges while Baurโs was set at $400,000.
In court Monday, Baur waived her rights to a preliminary hearing. Her arraignment is set for Oct. 30.
Meanwhile Vangโs preliminary hearing is set for Thursday.
Vang originally reported Elijah Vue missing on Feb. 20. At the time, an Amber Alert was issued.
For months, law enforcement agencies and volunteers searched for the toddler. In early September, a hunter out preparing his land for hunting season discovered skeletal remains. The remains were later identified as Vueโs.
According to the criminal complaint, Vueโs manner of death was homicide by unspecified means.
The doctors who examined the boyโs remains determined the toddler suffered from physical abuse, psychological and emotional maltreatment, as well as neglect. Doctors also found healed fractures on Vueโs skull and face.
Baur and Vangโs initial appearance on the new charges is scheduled for 1 p.m. Monday in Manitowoc County court.
