APPLETON, WI (WTAQ-WLUK) โ The police officer who shot and killed a man at an Appleton bar in January will not face criminal charges, state investigators say.
Officer Yeeleng Thor shot and killed Derk A. Brachmann on Jan. 23 at the Maritime Bar on Wisconsin Avenue.
The release of information indicates Outagamie County District Attorney Melinda Tempelis โdetermined there is no basis to prosecute the law enforcement officer involved.โ
The evidence released includes body camera video worn by Thor. In the video, a shot can be heard before Thor returns fire. He is later heard telling another officer that the gunman fired at him first.
The report indicates police were called just after 1:30 a.m. for a report of a shot fired at the bar. When Thor arrived, the report says patrons were running out of the building. After shots were exchanged, the report says medical aid and life-saving measures were attempted at the scene. Brachmann was taken to the hospital, where he was pronounced dead.
