GREEN BAY, WI (WTAQ-WLUK) — A judge heard arguments Wednesday on whether to dismiss homicide charges against a 15-year-old Milwaukee boy charged in a murder in a pharmacy parking lot, but did not issue a ruling.
Jeremiah Robinson allegedly shot and killed a 31-year-old man Feb. 18 outside the Walgreens store on the corner of Oneida and Mason streets. He is charged with first-degree intentional homicide and ten other counts.
Michael Balskus, Robinson’s attorney, argued there wasn’t enough evidence presented at a preliminary hearing to order Robinson to stand trial, and there was no specific finding of probable cause on the homicide count.
Assistant District Attorney Caleb Saunders argued that if the court were to find the commissioner failed to properly order the bind over, as part of this review, the judge could do so.
Judge Thomas Walsh cited specific lines from the preliminary hearing transcript which he said could be interpreted as a specific ruling on the homicide count, but wanted to review additional aspects of the law before making a decision.
Judge Walsh plans to issue a ruling at a July 8 hearing.
According to the criminal complaint, Robinson and another man, Jeromy Finke, got into a confrontation with the victim and another man over money. Robinson told police the dispute carried over to the outside of the store, and he shot the victim in self-defense after being threatened with brass knuckles.
The criminal complaint says the victim, identified only by his initials, was shot four times.
In Wisconsin, suspects ages 10 and older in homicide and attempted homicide cases are tried in adult court.
