APPLETON, WI (WTAQ-WLUK) – A mother pleaded not guilty Monday to a reckless homicide charge for the co-sleeping death of her two-month-old son.
No trial date was set for Nicole Sobay. She returns to court Aug. 11 for a pre-trial conference.
According to the criminal complaint, police responded to an apartment on N. Richmond Street on June 6, 2017. The person who called authorities reported Sobay said the child was ‘gone’ and had suffocated.
“Sobay mentioned sleeping with the infant in the same bed. She said when she woke up, the child was facedown and not responding,” the complaint states. “While outside in the parking lot, Ms. Sobay made a comment stating something to the effect that she does not drink often and she was hungover. She then stated she had passed out. She also made statements about the child being face down but not being able to roll over.”
Sobay’s blood tested positive for amphetamines, methamphetamines, opiates, and cannabinoids.
The medical examiner said the child died “from Asphyxia with High risk sleeping environment including bed sharing with an adult as a contributing factor (Significant Condition),” the complaint states.
