CHIPPEWA FALLS, WI (MetroSource-WSAU) The 10-year-old girl charged in the death of a 6-month-old infant will not stand trial. The girl was found not competent on Tuesday.
She is charged in the October 30 death of Jaxon Hunter. A criminal complaint says the girl, whose name is not public because of her age, dropped the child at a home daycare, and the panicked when he wouldn’t stop crying. She stomped on Hunter’s head, killing him.
State law requires that those who are at least 10-years-old and charged with first degree reckless homicide must be charged as an adult. Judge James Peterson said it is possible that the girl could be found competent for trial at a later date. She will be re-examined by a court-ordered psychiatrist in July. Until then the case against her is suspended.
