BREAKING: Wisconsin Assembly Passes Budget Without Debate 55-42

Driver was texting when she struck and killed bicyclist

VILLAGE OF KIMBERLY, WI (WTAQ) - Felony charges have been filed against a driver who struck and killed a bicyclist over the summer in the Village of Kimberly. 

Fox Valley Metro Police says it was a case of distracted driving. 

The driver, 19-year-old Pa Kou Xiong was texting and driving at the time of the incident that happened after midnight on on July 28th along Wilbur Avenue. 

Police say she did not see 46-year-old James Weiss, who was riding a well reflected bike, with lights.

Officer Scott Van Schyndel says Xiong was traveling above 30 mph in a 25 mph zone and drifted from the lane of traffic into the parking lane, hit the the curb, and then struck Weiss from behind. 

Xiong stopped and called 911.

Weiss was in critical conditon when he was taken to Theda Clark Hospital in Neenah.  He died nine days later. 

Van Schyndel says Xiong has been cooperative throughout the investigation.    

She was arrested last week, and felony charges of homicide by negligent operation of the vehicle have been filed by the Outagamie County District Attorney’s office.
