MARINETTE, WI (WTAQ) - City officials in Marinette are denying claims that their sign ordinance is unconstitutional.
The ordinance, which requires permits and a $15 fee to the city for the right to display the signs, drew the ire of Kristin Abbs. Abbs filed suit in federal court claiming it's illegal as it pertains to political signs.
Marinette's city attorney denied those allegations in court documents filed this week. The city also claims Abbs may not have the standing required to file the suit, and says it wasn't properly served.
A motions hearing is scheduled for Thursday afternoon before Federal Judge William Griesbach. The plantiffs asked for a temporary restraining order prohibiting the city from enforcing the ordinance.
Griesbach did not rule on the request earlier this month but the parties are expected to appear in court Thursday.
