STURGEON BAY, WI (WTAQ) - A woman from Door County has agreed to a plea deal with prosecutors in the case of leaving her infant daughter to die in her running SUV.
33-year-old Melissa Martinez pled no contest to a charge of neglecting a child with the consequence of death. Prosecutors agreed to drop a charge of homicide by intoxicated use of a motor vehicle.
However, the judge can consider that charge during Martinez's sentencing.
Eight-month-old Elena Martinez died in October. When the baby was found unresponsive inside the SUV in the driveway, police found Melissa Martinez inside her house.
The baby had been left in the SUV for several hours, prosecutors say. Four hours after the baby was found, officials say Martinez's blood alcohol level was still nearly 3 times the legal limit for driving.
Martinez faces up to 25 years in prison when she's sentenced September 7.
